You can almost literally be arrested for anything in Texas. If you are picking up your mail early one morning and have to cross the street and there is no traffic but a cop sees you jaywalking, he can arrest you and bring you to the county jail. So you have an arrest record and for what? Jaywalking. As far as group rules or constitutions, I guess to some extent, each can make his/her own rules. if the head coach for the girl's volleyball team has a rule and the girls know it, then that is a rule. Does the football team have to follow the same rules? I don't think so. I also think that each head coach can issue punishment as he/she sees fit for that team. I do think that the district needs a blanket code of conduct for UIL sanctioned events/teams however and those should not be deviated from. Get caught with illegal drugs for example and you need to lose you UIL eligibilty for at least that year. Get arrested for a felony and the same results. I think the UIL needs to have some basic rules of eligibility and conduct that is some cases takes the school out of it. Just like no pass-no play is a UIL rule, not an individual school district rule. If you can remove them from competing for grades, I don't see how or why you couldn't for drugs or felonies.

There should not be a form of punishment by the coaches, then allowed to play in ANY of these examples....correct? [/quote] Truancy is a school issue like acting up in class or a discipline problem. That should be up to the school and the coach. While it is true that you can be arrested for truancy, you can also be arrested for disrupting the classroom or failing to signal a turn while driving to school. In fact, every citation issued by an officer is an arrest but you are released on your own recognizance. I don't think kids should lose UIL privileges for citations. Those are not serious issues and are between the schools and coaches. I was talking about (and thought that I said) robberies, selling drugs, using drugs and other serious crimes. If you are selling dope, you should not be allowed the privilege to play sports or UIL sponsored events. If you are committing armed robberies... same answer. Breaking into homes? See Ya!

  4. They should all be the same no matter that activity. I am not sure about the being held to a "higher standard" though. They should just live to the standard of other students, not higher. The standard for society and students should be that you aren't out breaking the law by robbing the local store, selling dope, etc. If other students need to be to class on time, UIL participants should not be made to be there 10 minutes early. No need for the "higher standard", just "the standard".

[/quote] I don't know if they can or can't in this situation but I think it is possible for the law to allow them to do that. Navigable waterways are controlled by federal law and they can set what waters are used for. The feds can set all rules for the rights and uses of those waterways, even if contained entirely within a state. The states have the right to make laws that control the use of such waterways also just like with other laws. In other words, you can have dual jurisdiction however, either one can make something against the law and the other generally cannot trump that law. Now the feds could make a specific law that overrides state law such as if the feds said something like, "A state cannot make new laws regarding blah blah blah". An example of dual jurisdiction is that the federal government does not have laws on armed robbery (called Aggravated Robbery in Texas) but they do have laws on bank robberies because they are federally insured. Texas naturally has those Agg Robbery laws. In a bank robbery, they appear to conflict as Texas law on a bank robbery does not match federal law on bank robbery. In such a case the feds can prosecute under their laws or the state can prosecute under their laws or both can prosecute. They have dual jurisdiction with different statutes. Texas law cannot stop federal bank robbery laws and federal law cannot stop Texas's right to make their own robbery laws. It is the same in navigable waterways. Even is something is not against the law in Texas (using navigable waterways), that does not stop the feds from making a more restrictive law. The United States Code are all laws in the USA or the equivalent of the Texas Penal Code, Parks and Wildlife Code, etc. The US Code gives the federal government control over all federal waters which is all navigable waters. It has been upheld in court under the Commerce Clause part of the Constitution. The federal law is restrictive enough in use that there is even a federal law dealing with the Sabine Ship Channel. That's right folks, the federal government has a law that specifically names Port Arthur and Sabine Pass in navigable waterways, which coincidentally is the very waterway that we are talking about. There are also laws pertaining to safety zones around military installations and other vital infrastructure of which Sabine Pass has plenty. Here is part of the law from the USC. It says the waterways are free to be used by the public BUT Congress shall have control to make laws pertaining to protection, maintenance, etc. [size=10pt][b]United States Code TITLE 33 > CHAPTER 1 > SUBCHAPTER I > § 12 § 12. Port Arthur Ship Canal After there shall be conveyed to the United States, free of cost, a valid title to the line of water communication between Taylors Bayou and Sabine Pass, in the State of Texas, known as the Port Arthur Ship Canal,.......................the said waterways shall thereupon become free public waters of the United States, and be subject to the laws enacted by Congress for the maintenance, preservation, protection, and regulation of navigable waters: [/b][/size] The reason for federal control is obvious if you think about it. If it did not have such laws, Texas could for example, stop the military shipments from Beaumont to the Iraq and Afghan wars or all oil. The feds have to have control over such waterways. The words maintenance, preservation and protection gives the Congress wide latitude in making laws. Back to the main question about navigable waterways and fishing in Sabine Pass. The federal government has the right to control all navigable waterways in general and specifically has a law anyway for portions of the ship channel. Texas also has navigable waterway laws that says a private entity cannot block a navigable waterway from the public if that waterway has public access. That came up a few years back in this area when some people that owned land on either side of some local bayous and tributaries tried to block access to duck hunters by using barbed wire. They were under the assumption that since they owned all land on either side of the waterway, they could block it. Texas laws says no, it has to remain open. That law however has nothing to do with federal law restricting use for safety or commerce purposes. Clear as mud?
  6. Since crossbows are now legal to use during whitetail archery only season, I figured that a few more people might be trying them out and maybe even hunting archery season for the first time. For now, I am still using my compound.

I would think the R240 with two Yamahas would be easily a good offshore boat.

I think the heavy rains from the last week have killed the fishing for now. I work with a guy that guides on the weekends and they fished a tounament today and caught three keepers in several hours of hard fishing on the south end and at the jetties. Another guy that I work with that fishes all of the time did not catch a keeper gamefish of any kind in the same tourney. A few days and it will probably be back up and running full force if we don't get any more heavy rains.

Each photo or video has its own webpage and you can post that webpage on here but putting [img][/img] around the page. I know on photobucket, you click on the post photo option below the picture and it adds that automatically for you. I use photobucket. Go to that and sign up for the free account much like signing up for this forum. Then start posting away.

[/quote] i went to the terminal next to the coke dock and worked my way along the channel at any light i can find.  Saw a lot of movement and bait fish but couldnt find any trout [/quote] They are with the bait but we are having a hard time finding bait right now. Four weeks ago you could wade across the ship channel on shad. Now I have a hard time finding any. That is why I want the rain to stop.

[/quote] That is true but in my mind, what an adult does to his own body is his business from an employment standpoint. As long as it does not interfere with his job or endanger the public I don't really care. Now with teachers/admin, etc., I can understand the performance aspect of it. The employee needs to show up and ready to do the job. From a law enforcement perspective, I understand the fact that it can be a crime but is it the business of a school district to be enforcing or investigating criminal law? Their business should be to make sure that their employees show up on time and ready to do their job. If a substance interferes with that then it is an issue and even with a legal substance like alcohol. Children/students are a different issue entirely. What we do or require from or for children to protect them in no way has any relation to what an adult employee does. It is not tit for tat.

  25. They are back again tonight. I watched a couple of coworkers put a couple on the bank that were over 20" and a few other keepers by the time I left.
