  2. Excellent scenario Hippy, and one I can truly believe. I said he may have had another gun, but like you said, he possibly went for something. I just can’t bring myself to believe that these officers eliminated the threat without just cause.

  4. Why does that matter if he committed a crime? What if he just walked up, they seen the gun, asked him for his permit, he refused, said he didn't have it or his ID, or said I KNOW MY RIGHTS - since he was getting in the middle of what they were doing and not having permit/ID, they asked for the gun, he refused, a struggle broke out, one agent is able to get the gun, only one of the 5 agents see that, 2 seconds later, he reaches down to his empty holster (that not all agents know is empty), one agent yells gun gun gun - agents fire to eliminate the threat. The agent is going to claim he was in fear of his life or the other agents live cause he reached for the gun. If it makes it to court, which it won't because there is at least one supreme court ruling that supports this reasoning.

  6. My first response was fart smell, or whatever it’s called. That stuff would have had the whole room puking though. He had this stuff in a syringe and they haven’t identified it yet. What if it had been phenol or something else that could have killed her? They didn’t even try to get her to a doctor.

  19. According to the preliminary investigative report, he was in the street, impeding LEO’s, and refused to move. In other words, committing a felony. Does that in itself justify shooting? I’d say a definite ‘No.’ As far as my comment on possible medication for a purported rib injury, that’s all the more reason to not be carrying at the time. Another failure in judgement. Wouldn’t you agree? Carrying a loaded firearm if he was on opioids? If he was on opioids, (not saying he was) he shouldn’t even have been driving. So, how did he get to the scene to interfere?

  21. Oldawg brought up a valid point. The evidence will speak for itself. I still believe training played a part. Several mistakes were made. What ever the crimes people may believe he committed does not justify deadly force. The initial shot from the ICE agent followed by the 9 additional shots ended this man’s life. Do people even know what crimes he committed? Remember, it was reported that he came there to kill officers which was stated before any videos are evidence was collected. Now we know today that there was no supporting evidence to support he was there to kill agents. Now there is a lot of finger pointing.

  23. As an ICU nurse who supposedly was given medication for his ribs, I wonder if he was on oxycodone? Hadn’t thought of that… That would definitely impair his judgement.
  24. So CNN is Fake News....., that could be true - but there are medical records that back up CNN's story. End of the day, he could of attacked and beat up agents the previous week. It would not help or hurt this case. If true, it just shows he was making poor decisions that eventually led to his death.... I wonder who convinced this grown, apparently smart (ICU nurse) to commit crimes supporting a fake narrative?
  25. That’s an excellent breakdown—to me. If I understand what you’re saying, the two go hand-in-hand as a means to a decision. I’m not an attorney. But, it always seemed to say—in layman’s terms—to not just focus on the instant, but to look at ALL things without a definite time limit. Even those events that may not directly be involved in the specific circumstance. (i.e. recent threats, other stops that may have had an effect on the officer’s judgment, community events, etc.) That’s why I believe the agent/agents in the Pretti issue will have a strong argument that—while not pleasant to watch, and maybe not the best—they didn’t act with bad intent. They made a split decision under duress. Do I think they may be better suited for some type of ‘off the street duty?’ Yes. For their own psychological needs if nothing else.
