On social media folks freaking out about free speech....

This is NOT a free speech or 1st amendment issue.

Remind those folks that the FCC controls broadcast airways - They have guidelines - there are certain things you can't say...for example, watch local broadcast news, notice they don't drop F bombs? Notice if they play a clip with curse words, they bleep it? Did  we hear anyone in an uproar over the bleeps crying they are taking away our rights? Nope,,,,,

He was allowed to exercise free speech, no one stopped him, doesn’t mean there aren’t consequences, remember the Dixie chicks?

Kimmel was being paid by ABC. It's their call.

Had Kimmel did this on his social network platform, then that is free speech. It's not free speech when you are being paid to host a TV show. There are policies, rules and standards that the network have to abide by.

Kimmel actually thought he was untouchable in this instance. I bet he was really shocked with ABC having to suspend the show.

I find it difficult to understand how Kimmel and Corrola worked together on “The Man Show”. They are polar opposites. Kimmel wasn’t bad starting out. I guess he got indoctrinated and the big head. Money will do that.

I just find it hilarious that he went from exploiting the Juggy girls to lecturing the right on morality and social stances in less than 20 years.

BS. It’s a feee speech issue.

The Modern Legal Standard for Unprotected Speech

The “clear and present danger” test was replaced by a more rigorous standard in the 1969 Supreme Court case Brandenburg v. Ohio. This case established the current legal framework for when inflammatory speech loses First Amendment protection. The Brandenburg test is a two-pronged analysis: the speech must be “directed to inciting or producing imminent lawless action,” and it must be “likely to incite or produce such action.”

The issues surrounding free speech haven’t been addressed since this case. The internet & social media has complicated this issue as ‘imminent & likely’ are not known since what’s on the interwebs lives on indefinitely, and can incite an ‘immediate reaction’ at any time.

Of course, most employees are ‘at will’ and can be fired for any reason unless there’s another personal contract or service contract involved where other conditions have to be met.

Just to be clear, a free speech violation would be if he was arrested for what he said.  ABC has a right to terminate him like any employee.  Most in this state are at will employees.  He has a contact.  He will sue them.  They will claim they fired him for cause.  They will pay him millions of dollars to go away.  Poor Jimmy. 
 

(And to be clear, there are not many who champion free speech more than me.)

My understanding is that he hasn’t been technically ‘fired.’ They may still be paying him as an employee, and just stopped producing & broadcasting the show. Not quite clear on that part yet.

Haven’t paid attention to any of the late night shows since Leno left, and haven’t watched SNL in decades. None of them were funny any more.
