    21 for long rifles that have a detachable magazine.....so semi-auto 12 gauges will still be legal. 
     
    Here is my thought process. I don't think the act of making someone's first choice illegal will stop them from choice 2 or choice 3 if they are going to commit mass murder.  The next shooting where someone uses a couple sawed off 12 gauges in a confined area may change the weapon of choice for multiple shootings. People that commited won't let a law stand in their way. 
    I don't have a answer, I wish I did,  I just think these "feel good" laws hurt more than they help.

    I just don't think it will stop a shooter.  If I'm pissed at the world and decide to shoot up a school, I'll get a gun.
    The bill says it would restrict sales of "certain types of semi-automatic" rifles.  This is nothing more than the democrat playbook of getting a toe-hold with a seemingly benign restriction and slowing adding more "certain types of rifles" in the future.
    And I certainly wouldn't want to deny a responsible 20 year old with a job living in not the best part of town because it's all he/she can afford from being able to buy any weapon of his choice for self-defense.

    Under your scenario…
    You are indicted for OC-Agg Assault and facing 99 years. They have you stealing a handgun and selling the gun to a 17 year old. That is two state jail felonies with a maximum of two years on each count. Through your attorney they offer to accept guilty pleas in the crimes you actually committed but no deferred adjudication probation and you will testify in court that you sold the gun to one of the suspects and he told you what he was going to do.
    Or… they will not drop the Aggravated Assault charge but will allow you to plea guilty with a guaranteed sentence of 5 years (minimum for 1st degree felony) and the same testimony deal.
    Or… the same deal but a 10 year sentence and parole eligible at 5 years.
    To not take an agreed upon plea, you risk life in prison or up to 99 years, both of which can receive parole in 30 years.
     The worst plea deal I made up would probably have you home in five years…. You could risk 30 for parole.
    If it looked like a solid case against you, would you accept any of those deals?
    But we don’t even know what they really have on anybody. It is interesting to think of what may happen. Some of these later arrests might even have nothing to do with the shooting and just incidental crimes they ran into. Like while investigating where somebody might have gotten a gun, they inadvertently ran across a guy with a stolen credit card, which is a minor felony.
     
    And I highly doubt that they would offer immunity but anything is certainly possible.

    Obviously I have no clue at all about this serious incident…. 
    Let’s go out on a limb and say some of the people arrested are low level players like in my Organized  Crime examples. Like maybe they were not the actual shooters or the getaway driver but have been involved in other more minor crimes with a group.  Maybe they made a phone call to let people know that the party was underway.
     Whatever…..
    Because of the organized crime law however, the people that may not have actually took part in the shooting itself might be facing up to 99 years in prison. Do anyone think that through a lawyer, they might give up the right to remain silent and cooperate in prosecution in lieu of reduced charges?

    My dad had a auto parts store in Groves in the 80s. He was one those guys that could tell you a part # without looking it up. It always amazed me. Even if he did have to look it up, he knew exactly the book and page. When he shut it down and went to another store, they used computers. He was still faster on the catalog then the guys entering in numbers for year, make, model, engine, trans, a/c, doors. Lol. What do doors matter to the guy standing there needing an alternator??? 
    He still had some catalogs til Harvey flooded everything. Like he was saving them for Y2K 😂

    Go to a firearms counter at a big box sporting goods store and listen. 🤣
    I have heard things that are completely wrong. I am not talking like an opinion like brand A is better than B. I am talking about wrong.
     Even a young person at a specialty counter was expected to have some basic knowledge of the product. Not so much any more.
    I think I have told this story before, but a few years ago I was at Subway sandwich with my partner at work. He ordered a 6 inch sandwich and I ordered a 12 inch sandwich. The conversation went like this:   
    I would like a 12 inch on white bread.
    We don’t have that.
    OK give me a 12 inch wheat.
    We don’t have that.
    OK, what do you have?
    We have white, wheat, jalapeño cheese…
    OK, give me the 12 inch white.
    We don’t have that. Sir, all we have is 6 inch and foot long sandwiches. We don’t have 12 inch bread.
    My mistake, give me the foot-long white.

    When I was young the almost weekly visit to Hi/Lo Auto parts with my Dad was always fun. My Dad would bring in a part, and the sales clerk would almost guess what it came off of. I remember bringing in bolts, belts and hoses and the clerk would walk in the back and try and match parts. As I look back, it was simply excellent customer service. The other benefit of going as a kid was to check out the Hot Rods that most of he employees drove to work or possibly worked on during their breaks,,,,,lol
    Now, The reason for my post. I have an old homemade boat trailer with older style leaf springs. Where they mount to the trailer requires a rubber bushing. It's a very simple bushing....All three auto parts stores had no clue what is was when I put it on the counter.  Once I explained it was off a homemade trailer and what is was, one clerk looked me dead in the eyes and asked me for the model and year of my trailer....... 
    So I guess I'm old enough to remember when people that worked in auto parts stores actually knew auto parts.  
    If you are wondering why brick and mortar is a dying sales model, I found everything I needed online with free shipping, I just didn't want to wait the 2 days.......

    From the law…
    Sec. 22.01. ASSAULT.
    (a) A person commits an offense if the person: (1) intentionally, knowingly, or recklessly causes bodily injury to another, including the person's spouse;
     This is misdemeanor assault or assault with an injury (bruise, pain, etc.). Notice that it only requires to prove the injury was caused by being reckless. 
    Next is Aggravated Assault…..
    Sec. 22.02. AGGRAVATED ASSAULT.
    (a) A person commits an offense if the person commits assault as defined in Sec. 22.01 and the person: (1) causes serious bodily injury to another, including the person's spouse;
    or (2) uses or exhibits a deadly weapon during the commission of the assault.
    First a person must commit an Assault as defined in 22.01 which is to intentionally or knowingly OR recklessly causing injury.
    Then it becomes aggravated by either causing serious bodily injury OR using a deadly weapon.
    A firearm by Texas law is the only item specifically listed as a deadly weapon. Other things “could be”, depending on how used, which requires proof. A firearm requires no proof and just is a deadly weapon.
    "Deadly weapon" means: (A) a firearm or anything manifestly designed, made, or adapted for the purpose of inflicting death or serious bodily injury;

    I am sure but it will be likely concurrent.
    And a note on the law… just because it may (probably) come up later in the media.
    Aggravated Assault is a better charge than Attempted Murder. Things like Att. Murder or Manslaughter sound worse but Aggravated Assault is way easier to prove for the same penalty.
    An example is Attempted Murder carries a 20 year maximum sentence (2nd degree felony) and Aggravated Assault carries a 20 year maximum sentence (2nd degree felony).
    In Attempted Murder the state has to prove that the defendant’s intent was to kill the injured victim. So what if the victim was a bystander? Maybe the shooter/defendant was shooting at A and accidentally hit B. How do you prove intent to kill B when it was an accident remembering that B was a bystander. 
    Aggravated Assault only requires the state to show that the defendant “recklessly” injured victim B.
    So would the DA rather try to prove “intent” which is not only way more difficult, it might actually be true that the defendant did not want to injury victim B or would the DA rather try to prove that B was recklessly injured, meaning an accident, but caused by someone acting recklessly?
    Remember that both are 2nd degree felonies with a 20 year maximum.
    I could just about guarantee that they will be charged with aggravated assault for the victims who did not die and Facebook will explode with comments about how stupid the DA is and the police don’t have to investigate because it should be Attempted Murder!!!
    No, it should be Aggravated Assault.

    I was off duty and on the way home but in uniform (in my personal vehicle) about 10 years ago. I stopped a guy parked in a handicap parking spot at a pharmacy where I had stopped to pick up a prescription. He had no license plate or hang tag and admitted to not being handicapped. His wife was with him.
    I hardly made any public contacts on traffic stop but that is maybe a pet peeve. Not unusual in this kind of a situation, he could’ve parked 10 feet away in a regular parking spot and half the parking lot was empty. 
    Since I was off duty and did not have a ticket book, I contacted the dispatcher by walkie-talkie and asked for a patrol unit to check by with me. A lieutenant showed up (actually my lieutenant and I was one of his sergeants) since he was on the way home also but he had a take home patrol unit, so had his ticket book.
    So the lieutenant agreed with the citation and begin writing it. As a routine, the guy was checked for warrants. Oops! He had a couple of traffic tickets that we that he had not paid and warrants for his arrest. So he started boohooing and his wife was crying.
    Geez…. I know that you don’t want to go to jail but you have warrants so no option but it’s only for traffic citations.
    What does this have to do with Jerry Springer?
    All the crying was because they were supposed to catch a flight the next morning (in about 14 hours) to NYC to be on the Jerry Springer Show. I said just pay for the warrants. Nope… they had no money. These folks from the country (like a heavy east Texas accent) were about to miss their dream shot at NYC because the about 30 year old healthy guy didn’t want to walk 10 more feet.
    I asked them why they were going to be on the show. The guy told me he was supposed to claim that he was having an affair with his wife’s sister and they were supposed to get in the big argument when he springs the information on his wife. Of course the sister-in-law would then walk on stage.
    I asked him about being paid and he said they would get something like $500 but got to stay in New York City with all expenses paid for a couple of days.

    Yes.

    You can watch about a 10 minute YouTube video of multiple NASA(and formerly NACA) test rockets exploding on the pad or soon after liftoff.
     Certainly they wanted a completely successful flight but flying true for several minutes probably more than accomplished their testing goals.

    I have yet to see any reasonable explanation from anybody as to why misreading an address allows a person to threaten you with a firearm. As LR posted the article of a mistaken address and some guy thought that was justification to come out shooting.
    Where are y’all coming up with these nonsensical theories?
    This is not difficult. Tragic, yes, but not difficult.
    The police were called to a family disturbance. They walked across the street to the wrong house. They knocked on the door and announced police. Somebody inside the house heard the knocking and the man walked out without knowing anything, except that was a knock and immediately pointed gun at whoever was standing on his property.
    The (1) officers were not violating any law, (2) they had the same authority on stand your ground and (3) they had a reasonable belief that their lives were in danger. Can anyone point to where any of that is incorrect?

    I am saying that the GPS doesn’t show the exact house or location in the map program. 
    GPS can ping the nearest tower from a cell phone which is probably 98% of calls.  I have seen many times a person call 911 but can’t give an exact location and the tower might show the call coming from about a five square block area. 
     The officers didn’t kick a door, they knocked. If someone knocks on your door, do you open the door without looking outside with a gun in hand? What if the officer was just on patrol and saw an interior light on inside the homeowner’s car and wanted to have the person come out and see if the car had been broken into. I have done that on several occasions. I would hate to think if the homeowner opened the door with a pistol in his hand pointing toward me.
