JustUs Posted April 9, 2014 Report Posted April 9, 2014 Can anyone in the know explain what's really going on in the process of getting a coach hired at OZEN ? Is Atkins in or officially out ? Is he allowed on campus ? Is there really a new list of applicants ? Is there a time line to start the interviewing ? Is there an attempt to get it done sooner than later ? panther blue 1 Quote
Guest Posted April 9, 2014 Report Posted April 9, 2014 Hiring a football coach prolly isn't a top priority for BISD right now...lol just saying. Quote
Bigdog Posted April 9, 2014 Report Posted April 9, 2014 Until the lawsuit is settled, if Atkins has formally brought one it will be up in the air. Unless the TEA makes a quick decision when they come in. Quote
ozensfinest Posted April 9, 2014 Report Posted April 9, 2014 Atkins will not be able to sue BISD because he never signed a contract, as far as a new coach I have no clue what's going on with that. Quote
BearWolf Posted April 9, 2014 Report Posted April 9, 2014 A new head football coach will be named next week, the 17th. Yeoj 1 Quote
JustUs Posted April 9, 2014 Author Report Posted April 9, 2014 Anyone ''CAN'' file a Lawsuit whether they prevail is a matter of law. IMO Atkins has 3 choices: Accept what has been done to him, Fulfill the job the school board voted to give him(The Hire) or file his lawsuit to challenge the person who speaks with fork TONGUE  ....... Trust me, Atkins has a case and I expect him to either file lawsuit or BISD will "settle" out of court. BellBiz30 1 Quote

He can file a lawsuit but he doesn't have a case, it was only agreed upon by the schoolboard that he was supposed to be the new head coach. He have nothing in black and white that say BISD has to allow him to be head coach. Quote

Knoddy1 Posted April 9, 2014 Report Posted April 9, 2014 I kind of doubt he had time to move to Beaumont. and if he does sue BISD how much do you think he would sue for, he did'nt sign a contract, so salary was never agreed on, as least not in writing. My guess is they may pay hiim a token amount just for him to go away but it would'nt be anything like a years salary. The guy that decides whether the TEA takes over said he will take his time, I think thats wrong, it's the kids time he is taking and they've had enough taken from them already. AggiesAreWe Posted April 9, 2014 Report Posted April 9, 2014 Atkins was put to work the day after he was approved by board. He was sent to be an admin at an Ozen track meet. Like I said, he has a case. Quote

Like I said, he has a case. I'm no lawyer but that would seem like a verbal contract at least.......But Texas is a right to work state...why can't they just fire him because of public opinion? That is not illegal. Quote
Knoddy1 Posted April 9, 2014 Report Posted April 9, 2014 Well then pay him for the track meet and send him on his way. Quote
AthleticSupporter - Jock Posted April 9, 2014 Report Posted April 9, 2014 Well then pay him for the track meet and send him on his way. But didn't this man quit a job to come take the Ozen job. Seems to me BISD would be liable for those lost wages as well, but I'm no lawyer. Quote
Mr. Buddy Garrity Posted April 9, 2014 Report Posted April 9, 2014 BISD wasting too much time with this situation. Quote
ozensfinest Posted April 9, 2014 Report Posted April 9, 2014 Man bottom line the guy didn't sign a CONTRACT with BISD word of mouth will get you nowhere in the court of law. Quote
Knoddy1 Posted April 10, 2014 Report Posted April 10, 2014 I though the school he was at closed ? Quote
Octfeb Posted April 10, 2014 Report Posted April 10, 2014 He has a case and will be paid by bisd. Your wrong I am pretty sure verbal agreements will stand up in a court of law... The burden of proof would be on him. That the verbal agreement actually took place. Quote
NDNation Posted April 10, 2014 Report Posted April 10, 2014 Wasn't it announced in the paper? Seems like I saw an article on it. Quote

NDNation Posted April 10, 2014 Report Posted April 10, 2014 Well then, seems like it was out there that he was hired. I think he has a case and proof to back it up. Octfeb 1 Quote
AHUDDLESTON Posted April 10, 2014 Report Posted April 10, 2014 I don't even try to pretend to know what will happen in court. I do know that when I have been hired at a school, I always get a letter of intent to hire immediately and then wait for the school board meeting to approve the contract. Without the LOI, I do not know how the lawsuit will end up. Remember McDonalds had to pay for coffee being too hot!!! :) Englebert, Octfeb and Mr. Buddy Garrity 3 Quote
