If the person is almost or is unconscious, that isn’t with consent. A person has to have the ability to say no. In most or all states there are implied consent laws when driving. When you drive a vehicle in public, by law you have already consented to taking a breath test or having blood drawn. You can verbally withdraw that consent but that becomes another penalty. However…. the Supreme Court has ruled that implied consent laws mean that if you are unconscious due to intoxication (or injury) and is unable to consent, it doesn’t matter. State law says that be driving you have already consented to giving up your blood. That is to show that an unconscious person can consent while driving merely by driving and being unconscious doesn’t matter. Why bring that up? There is obviously no such thing as implied consent for sex. A guy can’t say (like the police can with an intoxicated driver), “oh well, she didn’t say no”. But merely being intoxicated in my opinion should not matter. A girl could drink two beers while on a date and start feeling frisky and technically be intoxicated but fully aware of her situation. That is not the same as a person who is unconscious or nearly so. Also note that in this case it was brought up that they gave her ketamine. In Texas as an example, using a date rape drug like ketamine or rohypnol automatically kicks it to a First Degree Felony or equal to Murder with up to 99 years in prison. In such a case I don’t think probation is allowed. So assuming this was in Texas and it could be proven that they gave her ketamine, consent doesn’t seem to be an element to the offense because the use of the drug removed any voluntary consent. That’s why there is a specific law on using drugs to render the (usually) female unable to say no. I don’t know the laws in that state but they are probably similar. If the prosecutor “can prove” any person had sex with her after she was given ketamine, they will likely be facing many years in prison and should be in my opinion. Proving it after not having a sexual assault examination for three weeks and certainly no blood tests for drugs in that time frame, will make it difficult.

I think this game comes down to coaching, two evenly matched teams with 2 totally different play styles. Whichever coach game plans and has their team ready to execute wins! I think play calling will be huge for HJ.

HC in his 2nd year and DC in his 1st year. Lots of 1st year players from the draft and trades. Some things take time to gel. I’m always glass half full. Dallas wasn’t prepared for the Giants, but they’re in 1st place. Should have beat the Ravens, but I can’t dwell on it. Texans game just shows that you better be ready every week. Texans made the playoffs last season with an 0-3 start, so there is always a light. You have to look for it. Don’t start wearing a sack over your head just yet.

Why, because I am a Cowboy fan and simply tell it like it is. I said in the 2 wins that they had to score a lot of points and they did. Yes, the offense play an outstanding 2nd half. The defense on the other hand was pitiful. In fact they tried to give it away again after Dallas got the lead of 27-24. Thank goodness the offense bailed them out. The Texans did not play well with all the penalties It seems to me that you want to give out opinions, however you don’t want to read any, and as I said IMO, Dallas defense is horrible. Do you think that may be why they are almost last in the NFL in every defensive category?

You know what, the game isn’t decided by just one team. The Texans played an excellent game but were outscored. Dallas played one heckuva second half…..converting 3rd downs and a crucial 4th and 4. The defense getting a sack on 3rd and 3 which allowed us to get the ball back. Why didn’t you watch the other game that was on at the same time, since your teams never measure up to your perfect standards?

Dallas continues to have the worst defense in the NFL IMO. The secondary covers no one(I am not sure if they cover an orange practice cone). The DL allows the QB to eat a bag of popcorn on the majority of his pass attempts and the LB’ers are usually lost as a goose. They are 2-2 due to the offense scoring a lot of points in the 2 wins. As of today I don’t see them making the playoffs
