According to his weight he would've "sweated" off and burned off or sobered up about .01 percent each 40 minutes (got that from wikipedia, [Hidden Content] ). So according to the chart his BAC would've been .074 at the time he made the call at 3:45. So therefore he was not intoxicated when he made the call. Just putting the facts out there.

There is also the question if the intoxication was an intentional aforethought to the crime ("I wanted to get drunk so I had the nerve to kill her.") Thus, unintentional intoxication can show lack of capacity to form an intent and thus reduce the possible level of conviction and punishment, as from voluntary (intentional) manslaughter down to involuntary (unintentional but through a wrongful act) manslaughter. However, in vehicular manslaughter, the intoxication is an element in the crime, whether getting drunk was intentional or not, since criminal intent was not a factor. According to this noone can say weather or not was intoxicated or not at the moment because noone saw him before he died. Yes he had .069 alcohol in his blood but that does not prove he was intoxicated.

As I mentioned in an earlier post, players or other groups can pray before the game alone or in groups all they want. A citizen can get a megaphone and say a prayer in the stands to his heart's content. It makes me wonder when we who are Christians hear them announce a moment of silence, we can't pray without hearing it on the loud speaker. I always say a silent prayer during those moments of silence asking for everyone to return safe to their homes. I guess God isn't hearing me unless someone announces it on the PA system? [/quote] Last year. Need i say more? If this was a ranking according to last year then that would matter but we are talking about this year incase you didn't notice. And 15 points isn't a blowout but holding a team that is averaging 362 yards per game to 139 is shutting them down. And i never said CS can't hang with us. I just think they would lose. CS found out what a real defense is this last week and barely came away with a win. They are a great team but comparing them to Ned and Vidor is laughable at best.

Hopefully we get a Sumlin type, but i doubt it. If the Walter twins leave i bet its further west not east. Bh can't handle speed at all it looks like hints they lose. It's whatever but i'm just pointing out that the matchups do matter more than the districts. Vidor is a better team than Crosby Ozen is a better team than BH however that doesn't mean PNG/Nederland are better teams than either. All in all, it should be a pretty close game...much more so than Montgomery/Huntsville or Vidor/Crosby.  I think how well the Vidor defense does against our 430 yard and 42 point per ganme offense will be the decising factor.  I cannot wait! [/quote] Just a few corrections there. Montgomery is averaging 247 yards per game defensively. Not less than 200. And They are averaging 419 yards per game offensively. Not 430.
