But even though he is on the House Judiciary Committee, he seems to have no actual understanding of how the enforcement of laws work in the criminal context. He told Kaitlin Collins yesterday that if there is a failure to comply with his statute, it will be enforced criminally, and people will go to jail. 1. The only thing the statute does is force the creation of a searchable and downloadable database of materials. 2. The statute orders the Attorney General to create this database. 3. The statute leaves a variety of discretionary judgments to the Attorney General on what documents to include. 4. The statute does not include any provisions that give notice to anyone that non-compliance is a criminal offense. 5. Massie says "their" -- he and Khanna -- method of enforcement will be "legal." But here is the problem that shows how little Massie understands about the law: The obligation to create the database is placed upon the Attorney General. Who is it in the U.S. government that is given the authority to decide when to bring criminal charges and who to charge? Due process under the 5th Amendment requires "Notice and Opportunity to be Heard". Where in the statute is "Notice" provided that non-compliance is potentially a criminal offense? Quote
