  1. Past hour
  2. There is a difference, but I wouldn't at all put it past Trump to do so if he had the infrastructure in place to get away with it like the Dems currently do. With the amount of effort he's invested in ruining those republicans who've opposed him, it wouldn't surprise me one bit.
  3. I think it will be an interesting case and could potentially come up for appeal on a different constitutional point. The Supreme Court has ruled in the past that the government doesn’t have to take possession of property in order to take it under the meaning of the Fifth Amendment. If they take away the enjoyment or use of the property, it is no different than physically seizing it to build a highway for example. In a lawsuit as opposed to a criminal trial, a person/plaintiff doesn’t have to prove something beyond a reasonable doubt but rather by a preponderance of evidence or “more likely” to have happened. Maybe it could be described as more likely yes than no or 51%-49%. ”IF” it can be shown at a trial by a preponderance of evidence that Texas more likely yes than no caused the flooding with its engineering of the project, the people suing might have a case. But…. Does that alone win the case under the Fifth Amendment taking clause? I am not so sure. In US v Causby the Supreme Court ruled that the US government took a man’s property by flying airplanes over it. It was a public airport lawfully leased by the US in WWII and used to fly heavy bombers from it. Causby had an egg farm and the extremely loud noise of some airplanes under full power and sometimes at night with a landing lights being so close, it bothered and scared the family and damaged his egg farm production. Some chickens died and some quit laying eggs due to the extreme disturbances and lights at night. The Supreme Court ruled in Causby’s favor saying that the US had taken away the enjoyment and use of his land even though they didn’t physically seize it. The use of the land was hampered and that was enough for the taking clause under the Fifth Amendment. So in the IH-10 case, did Texas take away the use or enjoyment of the property? A point of Causby was that the military bombers at a public airport was certainly for “public use”. The planes were public/taxpayers’ and the airport and lease were taxpayers’ property so the “public” definitely used it My question in this lawsuit against Texas, even in they can prove the damage, was the damage (like in Causby) for “public use”? If not would it then not be a Fifth Amendment case but rather a state law case? If Texas law denies such a lawsuit under state sovereignty and the families can’t prove a Fifth Amendment case of “public use”, could they prove the damages but still lose the case under state law? I haven’t read that anywhere and just thinking out loud. I could be way off base. But I think it could be interesting…..
  4. Both sides...that is, everyone tries to get their people elected. Trump has not weaponized the government to bankrupt and imprison his political opponents. Night and day difference for me.
  5. Surely you're aware of the great lengths Trump has gone to disrupt the elections and destroy the careers of republican politicians who haven't supported some of his most outlandish claims, or dared to question him or disagree with him about January 6. You and I actually agree on this issue, although it must only go one way for you, because Trump's actions against republicans who didn't fall into lockstep with him is one of my biggest concerns about reelecting him. The fact that he took action to affect literally hundreds of republican primaries from national elections down to municipal levels across the country, is concerning. It would've been one thing had he done it in an effort to help republicans win. Instead his purpose was to push out his perceived detractors and install MAGA politicians at every level of government in as many places as possible, and has resulted in a fractured republican party.
  6. Lmao. No doubt. With a name like that, he would've gotten made fun of even if he was home-schooled.
  7. Poor guy, I'm sure middle school was a blast.
  8. Today
  9. Things to consider: 1. He's the publisher for the ENQUIRER 2. His name is Pecker 3. His name is Pecker
  10. The 30-40mph wind gusts we're supposed to have this weekend could make things a little chaotic.
  11. Stay classy NDN, and keep the personal stuff out of the thread.
  12. Try reading. I asked if you were the person on facebook posting the same comments under a fake name. @Bigdog bark at your own people.
  13. JoeBama's’s pro-migration border chief is opening new processing centers for Muslim migrants, amid pro-HAMAS riots in U.S. cities and just after Congress granted $3.5 billion more for migration within the $95 billion aid package for Ukraine and Israel. “Not only did the ‘Foreign Aid’ package do nothing to secure our own border, it included $3.5 Billion to supercharge mass migration from the Middle East,” said a tweet from Sen. Eric Schmitt (R-MO). [Hidden Content]
  14. Denial is also in that book. Maybe you should read it.
  15. I'm glad Trump is the nominee and future president. I think one of our most pressing crisis right now is the corruption in our goverenment (FBI, DOJ, IRS, etc) and in the Democrat party. They have sunk to banana republic tactics, and if nothing is done, they will continue these methods. Imprisoning and bankrupting political opponents should not and cannot be tolerated. These things can and will topple a great nation. I don't know if Trump will go after the Demcrats and the goverment agencies that have gone after him, but he definitely has the motive to do it. I don't think any of the other Republican candidates would seek justice against these anti-Americans. As a bonus, Trumps policies have been shown to be a great boon for our country (and nobody on here can prove that to be wrong). I fear that without retribution to what the Democrats have done, this country is on a speedy and unstoppable downward spiral. I think my hatred of what the Democrats have done to our country is greater than the hatred CardinalBacker has for Trump. Well, I shouldn't get carried too far away.
  16. Did you elevate yourself to this level of judgmental superiority after the first or second time you voted for Trump?
  17. If that's what you want to believe.
  18. Difference is, your shot was weak. LOL!
  19. A pinched nerve in the same arm is still an injury we're arguing over semantics (it supplies blood the the arm which was injured) and as far as a fake username I've been around a long time here I don't appreciate the connotation
  20. Most voters doubt Biden’s physical, mental fitness to be president, Trump’s ability to act ethically: poll | Fox News "Most American voters have little confidence that President Biden possesses the physical and mental fitness required to serve another term in the White House, while a similar majority is concerned that former President Trump would not act ethically if elected, according to a new poll." Pretty much sums it up for me. I'll take the unethical guy and hope that he sticks with similar policy to what he did the first time, but no way i actually trust him. It's still mind-blowing to me that this is the matchup we have for the second election running.
  21. I don't care what it is. You are spreading misinformation about the kid. It wasn't because of a past injury. It didn't happen during footwork drills. And I bet you didn't run any Oklahoma drills in helmets only. I am just curious now if you are the same person hiding behind a fake username on facebook making dumb comments as well.
  22. Do you feel you are a decent and moral person? You try to group all MAGA supporters (including me) as lacking those things. Do you include yourself as having these values, especially after looking at the way you treat others? Are you above MAGA folks in moral standing? Are you above me in moral standing? Are you directly impugning my moral standing because I will choose to vote a certain way? Tell me again, who lacks decency and morality?
